Terms of Service — ScanMePass

1. Acceptance of Terms

By accessing or using ScanMePass ('the Platform'), you agree to be bound by these Terms of Service ('Terms'). These Terms apply to all users including event organizers, exhibitors, and event attendees. If you do not agree with any part of these Terms, you must not use the Platform.

2. Description of Services

ScanMePass provides a cloud-based visitor registration and event management platform that includes online pre-registration forms, QR code pass generation and delivery, mobile-based QR code scanning for entry verification, real-time attendance dashboards and analytics, exhibitor and booth management tools, and post-event reporting and data export capabilities.

3. Account Registration and Responsibilities

You must provide accurate, complete, and current information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account.
You may not share your account credentials with any third party.
One account per organization is permitted unless otherwise agreed in writing.

4. Organizer Obligations

Event organizers are solely responsible for obtaining necessary permissions and consents from attendees for data collection.
Organizers must comply with all applicable privacy laws including GDPR and the Indian IT Act when using visitor data.
Organizers must not use the platform to collect data for purposes beyond the stated event management scope.
Organizers are responsible for the accuracy of event information published through the platform.
Organizers must ensure their use of ScanMePass complies with venue regulations and applicable local laws.

5. Acceptable Use Policy

You may not use the Platform for any unlawful purpose or in violation of these Terms.
You may not attempt to gain unauthorized access to any portion of the Platform or its related systems.
You may not upload or transmit viruses, malware, or any malicious code.
You may not scrape, crawl, or systematically extract data from the Platform without prior written consent.
You may not impersonate any person or entity or misrepresent your affiliation.
You may not use the Platform to send unsolicited communications (spam) to attendees.

6. Intellectual Property

All content, features, and functionality on the Platform — including software, text, graphics, logos, and data compilations — are the exclusive property of ScanMePass and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform solely for your event management purposes. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

7. Payment and Billing

Fees for ScanMePass services are agreed upon in a separate order form or service agreement. All fees are due in advance unless otherwise specified. We reserve the right to suspend services for accounts with overdue payments. Refunds are handled on a case-by-case basis as outlined in your service agreement. All prices are exclusive of applicable taxes unless stated otherwise.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ScanMePass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Platform. Our total liability for any claim shall not exceed the fees paid by you in the three months preceding the claim.

9. Disclaimer of Warranties

The Platform is provided on an 'as is' and 'as available' basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure. We make no warranties regarding the accuracy, reliability, or completeness of any content on the Platform.

10. Termination

Either party may terminate these Terms at any time with written notice. We reserve the right to suspend or terminate your access immediately if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Platform ceases immediately. You may request export of your data within 30 days of termination.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India. We encourage parties to first attempt to resolve disputes through good-faith negotiation before resorting to legal action.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of changes constitutes your acceptance of the revised Terms.
